1. Definitions

1.1. The following terms are used in this Privacy Policy:

1.1.1. “Website Administration of www.alekseifx.ru (hereinafter – the Site)” – authorized personnel managing the Site on behalf of photographer Alexey Yuryevich Martynyuk, who organize and/or carry out the processing of personal data, as well as determine the purposes of processing personal data, the scope of personal data to be processed, and actions (operations) performed with personal data.

1.1.2. “Personal Data” – any information relating to a directly or indirectly identified or identifiable natural person (personal data subject).

1.1.3. “Processing of Personal Data” – any action (operation) or set of actions (operations) performed with or without automation tools with personal data, including collection, recording, systematization, accumulation, storage, clarification (updating, modification), extraction, use, transfer (distribution, provision, access), anonymization, blocking, deletion, or destruction of personal data.

1.1.4. “Confidentiality of Personal Data” – an obligation for the Operator or any other person who has accessed personal data not to allow its disclosure without the consent of the personal data subject or other lawful grounds.

1.1.5. “Website User (hereinafter – the User)” – a person who has access to the Site via the Internet and uses the Site.

1.1.6. “IP address” – a unique network address of a node in a computer network built on the IP protocol.

1.1.7. “Cookies” – a small piece of data sent by a web server and stored on the user’s computer, which the web client or web browser sends back to the web server in an HTTP request each time the corresponding page is accessed.

2. General Provisions

2.1. Use of the Site by the User constitutes agreement with this Privacy Policy and the terms of personal data processing. The User is informed and agrees that consent given electronically on the Site fully complies with personal data legislation and confirms its receipt.

2.2. If the User does not agree with the Privacy Policy, they must stop using the Site.

2.3. This Privacy Policy applies only to the Site. The Site Administration does not control and is not responsible for third-party websites that the User may access via links on this Site.

2.4. The Site Administration does not verify the accuracy of personal data provided by the User.

2.5. By registering on the Site, the User voluntarily and explicitly accepts the terms of the User Agreement and agrees to the processing of their personal data in accordance with this Privacy Policy.

3. Subject of the Privacy Policy

3.1. This Privacy Policy establishes the obligations of the Site Administration to ensure confidentiality and protection of personal data provided by the User upon registration.

3.2. Personal data allowed for processing under this Privacy Policy are provided by the User through the registration form on the Site and include:

User’s first and last name;

User’s contact phone number;

Email address.

3.3. The Site protects data automatically transmitted when visiting pages with statistical scripts (“pixels”), including:

IP address;

Cookies information;

Browser information;

Access time;

Referrer (previous page URL).

3.4. Disabling cookies may make it impossible to access parts of the Site requiring authorization.

3.5. The Site collects statistics on IP addresses of visitors to identify and solve technical issues and to monitor the legality of financial transactions.

3.6. Any other personal information not mentioned above (purchase history, browsers and operating systems used, etc.) is securely stored and not disclosed, except as provided in clauses 5.2 and 5.3 of this Privacy Policy.

4. Purposes of Collecting Personal Information

4.1. The Site Administration may use the User’s personal data for the following purposes:

4.1.1. Identification of the User registered on the Site.
4.1.2. Providing the User access to personalized Site resources.
4.1.3. Establishing communication with the User, including sending notifications and requests regarding Site use, services, and processing User inquiries and applications.
4.1.4. Determining the User’s location for security purposes and fraud prevention.
4.1.5. Confirming the accuracy and completeness of personal data provided by the User.
4.1.6. Processing and receiving payments, confirming tax obligations or benefits, disputing payments, and determining the User’s eligibility for credit lines.
4.1.7. Providing effective client and technical support in case of problems using the Site.
4.1.8. Conducting advertising activities with the User’s consent.
4.1.9. Providing the User access to partner sites or services to receive products, updates, and services.

5. Methods and Terms of Processing Personal Information

5.1. The User’s personal data are processed without limitation of time, by any lawful means, including information systems with or without automation tools.

5.2. The User agrees that the Site Administration may transfer personal data to third parties (couriers, postal services, telecommunications operators) solely to fulfill the User’s order placed on the Site.

5.3. Personal data may be transferred to authorized government authorities only as required by law.

5.4. In the event of loss or disclosure of personal data, the Site Administration informs the User.

5.5. The Site Administration takes necessary organizational and technical measures to protect the User’s personal information from unauthorized or accidental access, destruction, alteration, blocking, copying, distribution, and other unlawful actions of third parties.

5.6. The Site Administration, together with the User, takes all necessary measures to prevent losses or other negative consequences caused by loss or disclosure of the User’s personal data.

6. Obligations of the Parties

6.1. The User shall:
6.1.1. Provide the personal data necessary to use the Site.
6.1.2. Update or supplement personal data in case of changes.

6.2. The Site Administration shall:
6.2.1. Use the information only for the purposes stated in clause 4 of this Privacy Policy.
6.2.2. Keep confidential information secret, not disclose it without prior written consent of the User, and not sell, exchange, publish, or otherwise share personal data, except as provided in clauses 5.2 and 5.3.
6.2.3. Take precautions to protect the confidentiality of personal data according to standard business practices.
6.2.4. Block the User’s personal data upon request or in case of false data or unauthorized actions, pending verification.

7. Liability of the Parties

7.1. The Site Administration is liable for damages caused to the User by unlawful use of personal data, in accordance with Russian law, except as provided in clauses 5.2, 5.3, and 7.2.

7.2. The Site Administration is not liable for loss or disclosure of confidential information if:
7.2.1. It became publicly available before loss or disclosure.
7.2.2. It was received from a third party before receipt by the Site Administration.
7.2.3. It was disclosed with the User’s consent.

7.3. The Site Administration is not responsible for partial or full inaccessibility of the Site due to maintenance or technical work.

7.4. The User is responsible for any damage caused by use of materials obtained through the Site.

7.5. The User is solely responsible for any issues arising during registration and Site use.

8. Dispute Resolution

8.1. Prior to going to court, disputes between the User and Site Administration require submission of a written claim for voluntary settlement.

8.2. The recipient of the claim must respond within 30 calendar days.

8.3. If no agreement is reached, the dispute will be submitted to a court in accordance with applicable law.

8.4. This Privacy Policy and relations between the User and Site Administration are governed by applicable law.

9. Additional Conditions

9.1. The Site Administration may amend this Privacy Policy without the User’s consent.

9.2. The new Privacy Policy comes into effect upon publication on the Site, unless otherwise stated.
